Member Information Collected by STACK
Personally Identifiable Information
You provide certain personally identifiable information (such as your name and email address) to STACK when choosing to participate in various activities on the STACK Websites such as registering, creating a public profile, uploading videos, posting messages, entering contests or sweepstakes, taking advantage of promotions, responding to surveys, watching videos, or subscribing to newsletters or other mailing lists.
How STACK Uses the Member Information
Personally Identifiable Information
If you submit personally identifiable information to us through the STACK Websites, then we use your personal information to operate, maintain, and provide to you the features and functionality of the STACK Websites. Any personal information or video content that you voluntarily disclose online (within your public profile page, in messages and posting areas, etc.) becomes publicly available and can be collected and used by others. Your account name (not your email address) is displayed to other Members when they view your profile and when you upload videos or send messages through STACK Websites and other Members can contact you through your profile, messages and comments. Any videos that you submit to the STACK Websites may be redistributed through the internet and other media channels, and may be viewed by the general public. We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major STACK Website changes or for customer service purposes).
Third Party Tracking and Online Advertising
We may permit third party ad networks, social media companies, and other third party services to collect information about browsing behavior from visitors to our Service through cookies, social plug-ins, or other tracking technology. We may permit third party online advertising networks to collect information about your use of our websites over time so that they may play or display ads that may be relevant to your interests on our Service as well as on other websites or services. Typically, the information is collected through cookies or similar tracking technologies. The only way to completely “opt out” of the collection of any information through cookies or other tracking technology is to actively manage the settings on your browser or mobile device. Please refer to your browser’s or mobile device’s technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. STACK allows Members to provide information to a profile that is accessible to other Members. We use this profile information for the purposes of providing our services to you, such as to analyze demographics, to better personalize our various offerings for Members, or to enable other Members to find your profile. All information, including any personally identifiable information, which is disclosed by Members in his or her public profile and journal entries are available for others to see. We caution you not to share sensitive information (such as social security numbers, credit card numbers, and driver's license numbers) with other Members whom you do not know or place such information in your profile.
The New Member Invite feature is an easy way for Members to invite friends through email. The email address(es) that you supply to use this service will only be used to send invitations to join the STACK Websites.
Surveys and Contests
At various times we may offer surveys or contests to Members. Surveys may ask for contact, demographic or unique identifying information to increase the value of the results. Contests may require contact information or other demographic or personally identifiable information in order to determine eligibility. STACK may use information collected from surveys and contests for the entertainment of Members, and to determine, notify and contact winners of various contests. In addition, Member's demographic and/or personally identifiable information and responses to survey and contest questions may be used by STACK and/or shared with third parties in order to provide specifically tailored special offers or advertisements. STACK will not share a Member's email address with third parties unless the Member specifically opts-in to such sharing during the completion of or registration for a survey or contest.
When STACK Discloses the Member Information
To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you profile access or making corrections. You are responsible for maintaining the secrecy of your unique password and account information at all times.
Third-Party Links and Ad Servers
STACK allows other companies, called third-party ad servers or ad networks, to serve advertisements within the STACK Websites. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the STACK Websites. They automatically receive your IP address when this happens.
STACK does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. However, please note that if an advertiser asks STACK to show an advertisement to a certain audience or audience segment and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they are trying to reach. The advertiser may also use information regarding your use of the STACK Websites, such as the number of times you viewed an ad to determine which ads to deliver to you.

STACK uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to STACK and you do so at your own risk. Once we receive your transmission of information, STACK makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
If STACK learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. STACK may post a notice on the STACK Websites if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.
Individual Rights of Individuals within California, U.S.A.
The California Consumer Privacy Act (CCPA) creates certain individual rights for California residents. This notice provides a general overview of the privacy rights under the CCPA. Further, it applies generally to all of STACK’s products and services.
The CCPA defines certain terms in a particular manner that may differ from how those terms are used in everyday language. When these terms are used in this notice, they are used based on the definitions set forth in the CCPA. These terms are: “personal information”, “consumer”, “business purpose”, “commercial purpose”, “service provider”, “third party”, and “sale” or “sell”.
This section explains the rights of individual California residents.
- Rights of Access to Information and Data Portability Under the California Consumer Privacy Act
Upon request, we will tell a California resident the categories and specific pieces of Personal Information we have collected about that resident in the previous 12 months. In addition, we will tell a California resident:
- The categories of Personal Information we have collected about that California resident.
- The categories of sources from which the Personal Information is collected.
- The business or commercial purpose for collecting that California resident’s Personal Information.
- The categories of third parties with whom we share Personal Information.
- The specific pieces of Personal Information we have collected about that California resident.
- Right of Deletion of Personal Information
You have the right to request that we delete any of your Personal information that we collected from you and retained by us, subject to certain conditions and exceptions under the law. For instance, we have the right to retain Personal Information needed to:
- Complete the transaction for which the Personal Information was collected, provide a good or service requested by the California resident, or reasonably anticipated within the context of our ongoing business relationship with the California resident, or otherwise perform a contract between the business and the California resident.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.
- Conduct solely internal uses that are reasonably aligned with the expectations of the California resident based on the California resident’s relationship with us.

- Use the Personal Information internally, in a lawful manner that is compatible with the context in which the California resident provided it.
The identity of any person making such a request must be verified as a condition of deleting the Personal Information as requested.

- Sale of Personal Information
STACK does not sell personal information in its possession and has not done so in the preceding 12 months
- Policy Against Discrimination
STACK will not discriminate against individual California residents for exercising any of their rights under the CCPA, including by:
- Denying goods or services to the California resident
- Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties.
- Providing a different level or quality of goods or services
- Suggesting that the California resident will receive a different price or rate for goods or services or a different level or quality of goods or services
STACK does not knowingly collect or maintain personally identifiable information or non-personally-identifiable information on the STACK Websites from persons under 13 years of age, and no part of our website is directed to persons under 13. If you are under 13 years of age, then please do not use or access the STACK Websites at any time or in any manner. If STACK learns that personally identifiable information of persons under 13 years of age has been collected on the STACK Websites without verified parental consent, then STACK will take the appropriate steps to delete this information.
The STACK service is available only to Members who have a valid postal address in the United States.
Change of Ownership
In the event of a change in ownership, or a direct merger or acquisition with another entity, we reserve the right to transfer all of STACK's Member information, including email addresses and postal addresses, to a separate entity. All registered Members will be notified of any change in ownership, merger or acquisition of STACK's assets by a third party, and may choose to modify any of their registration information at that time.
STACK reserves the right to revise, amend, or modify this policy and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted on the website, and a Member's continued use of STACK will signify agreement to such changes.
